Grantham man assaulted men with bottle because he was tired

A Grantham man who attacked a noisy neighbour and his friend with a Jack Daniels bottle was spared jail after a judge accepted he “snapped” because of a lack of sleep.

Pasquale Rizzo, 32, admitted losing his temper when he returned to his Oxford Street home after finishing work and was kept up by a loud party, Lincoln Crown Court heard.

The court was told Rizzo became involved in a fight with his next-door neighbour and a friend after going downstairs to complain about the noise.

Andrew Scott, prosecuting, said during the scuffle Rizzo picked up a nearby Jack Daniels bottle and struck Mr Garratt three times before hitting Mr Robertson once.

The pair escaped serious injury, Mr Scott told the court. Mr Garratt was left with a bleeding nose and suffered blurred vision for around half an hour.

Mr Scott added that Rizzo had not taken the Jack Daniels bottle to the scene of the attack in the communal area of the property.

In mitigation the court heard Rizzo was a hard working man who was regarded highly by both his employer and landlord.

He pleaded guilty to two charges of assault causing actual bodily harm following the party on February 8 this year.

He was sentenced to nine months’ imprisonment suspended for 18 months, and was also ordered to pay each of his victims £200 in compensation. He must also pay £200 court costs.

Passing sentence Judge Sean Morris said: “I take the view this man snapped and acted out of character.”

He added: “You are a man who works hard and is highly thought of by your employer.

“On this occasion you came home, no doubt tired after finishing work, and were unable to sleep because of this party which had no doubt been going on for several days.

“People who work hard and pay their taxes put a lot into the social bank. On this occasion it your time to make a withdrawal.”
