Magistrates have no choice but to ban driver for three years

A DRINK-DRIVER was given the minimum possible sentence by magistrates - a three-year driving ban.

Kevin Joyce, of Station Street, Rippingale, was found to be over the drink-drive limit after being stopped by police whilst driving in Bourne on January 29 at around 9pm.

Police originally stopped Joyce because of a faulty rear-side light but he admitted to officers that he had drank a pint earlier in the day.

Judith Armstrong, defending, said Joyce had been celebrating the birth of a friend’s child and thought he had waited long enough before driving so as to be under the drink-drive limit.

As Joyce, 32, had previously failed a drink-drive test within the past ten years, magistrates had no option but to take his licence away for at least three years. However, Joyce was told he could regain his licence nine months early if he passes a drink-drive rehabilitation course while banned.

Magistrates fined Joyce £300 and ordered him to pay costs of £85 and a £15 surcharge.
