Wife gets restraining order against husband
A HUSBAND has been banned from seeing his wife after she successfully took out a restraining order against him at Grantham Magistrates’ Court this week.
Stuart Muir of Larch Close, Grantham, has been told he must have no communication with his wife, other than through his solicitors, after admitting a charge of persistently making use of a public communication network to cause annoyance, inconvenience or anxiety.
The court heard how Muir and his wife had separated before Muir sent the texts.
Jill Derby, prosecuting, said: “One particular text referred to her new partner, saying ‘it would be a pity if his brakes failed one morning on the motorway’.”
Giles Tyas, defending, said the texts were exchanged during a “robust exchange” from both parties but he accepted Muir had gone too far. Mr Tyas said relations between the pair broke down prior to the texts being sent after the victim made comments on Facebook.
Mr Tyas said: “She was telling people on Facebook that he was not the father of her unborn child. He would say that he is, of course.”
Muir, 31, was fined £65 and ordered to pay costs of £40 along with a victim surcharge of £15. The restraining order will last for one year.
Mrs Johnson, chairman of magistrates, told Muir: “Basically, it means no more communication whatsoever, unless through a solicitor.”
